Affiliate Program Agreement

Overview

Thank you for your interest in the Appraisal Inbox Affiliate Program. This agreement outlines the terms under which you may participate in our referral program and earn commissions for qualified customer referrals.

Definitions

“Affiliate” means you, the individual or entity participating in the Appraisal Inbox Affiliate Program.

“Appraisal Inbox”, “we”, “us”, or “our” refers to Appraisal Inbox and its products and services.

“Qualified Referral” means a new customer who: (1) has not previously been a customer or lead in our system within the past 1 year, (2) signs up for a paid Appraisal Inbox subscription through your unique affiliate link, (3) completes payment, and (4) remains an active paying customer beyond the 30-day money-back guarantee period. Commissions are only paid on net revenue actually collected by Appraisal Inbox.

“Commission” means the compensation paid to you for Qualified Referrals.

“Affiliate Link” means your unique tracking URL provided by Appraisal Inbox.

Relationship of Parties

You are an independent contractor and not an employee, agent, or representative of Appraisal Inbox. This agreement does not create a partnership, joint venture, or employment relationship. You have no authority to bind Appraisal Inbox or incur obligations on our behalf.

Program Enrollment

To participate in the Affiliate Program, you must:

Be at least 18 years of age
Provide payment details through our affiliate platform (Dub Partners)
Complete the affiliate application and be approved by Appraisal Inbox
Agree to all terms in this agreement
Comply with all applicable laws and regulations

We reserve the right to accept or reject any affiliate application at our sole discretion.

Commission Structure

Commission Rate

Affiliates earn a 30% recurring commission on all monthly or annual subscription payments from Qualified Referrals for the lifetime of the customer account.

Commission Qualification

A referral qualifies for commission when:

The referred customer clicks your unique Affiliate Link
The customer completes signup and enters payment information
The customer’s first payment is successfully processed
The customer remains active beyond any money-back guarantee period (30 days)

What Does Not Qualify

Commissions are not paid for:

Self-referrals or referrals of your own accounts
Existing Appraisal Inbox customers
Fraudulent or suspicious transactions
Refunded or charged-back payments
Customers who cancel during the money-back guarantee period
Plan downgrades (commission adjusts to reflect lower subscription amount)
Promotional discounts or credits applied to the customer account

Payment Terms

Payment Schedule

Commissions are paid monthly, approximately 45 days after the end of each calendar month to allow for refunds and chargebacks.

Minimum Payment

Minimum payout thresholds are configured in your Dub Partners dashboard. Balances below the threshold roll over to the next payment period.

Payment Method

Payments are processed through Dub Partners, our affiliate platform provider. You are responsible for maintaining accurate payment information in your partner dashboard. Note that Dub Partners charges processing fees (typically 3-5%) on payouts, which will be deducted from your commission payments.

Tax Responsibility

You are solely responsible for all taxes associated with commission income. Tax documentation and compliance (including Forms 1099 and W-9) are handled through Dub Partners. You agree to provide all required tax information through the partner platform.

Commission Adjustments

If a customer receives a refund or initiates a chargeback after we have paid you commission, we reserve the right to deduct that amount from your future earnings or request repayment. Negative balances carry forward until resolved.

Affiliate Platform

We use Dub Partners as our affiliate platform provider to manage tracking, attribution, payments, and tax compliance. By participating in this program, you also agree to comply with Dub Partners’ terms of service and platform policies. Tracking and Attribution

Your Affiliate Links are tracked through Dub Partners’ attribution system. Tracking windows and attribution rules are configured in your partner dashboard. Last-click attribution typically applies: if a visitor clicks multiple affiliate links, the most recent affiliate receives credit.

Marketing Guidelines

Allowed Activities

You may promote Appraisal Inbox through:

Your website or blog
Social media posts
Email marketing to your own list (no spam)
YouTube videos or podcasts
Paid advertising (with restrictions below)

Prohibited Activities

You may not:

Use misleading, false, or deceptive marketing
Bid on Appraisal Inbox brand terms in paid search
Engage in cookie stuffing or forced redirects
Send unsolicited commercial email (spam)
Impersonate Appraisal Inbox or claim to be an official representative
Use adult, violent, discriminatory, or illegal content to promote
Engage in click fraud or artificial inflation of commissions
Make income claims or guarantees on our behalf
Offer unauthorized discounts or special pricing
Post fake reviews or testimonials
Make unsubstantiated claims about Appraisal Inbox features or results
Use telemarketing or SMS without proper TCPA compliance

FTC Disclosure Requirement

You must clearly and conspicuously disclose your affiliate relationship when promoting Appraisal Inbox. This disclosure must appear:

Before or alongside affiliate links
In a manner that is easily noticed and understood
Using clear language such as “I earn a commission if you sign up through this link” or “Affiliate link - I may earn a commission”

Example compliant disclosures:

“This post contains affiliate links. I may earn a commission if you make a purchase.”
“Disclosure: I’m an Appraisal Inbox affiliate and may earn a commission from sign-ups.”

Social media posts must include hashtags like #affiliate or #ad where appropriate.

Compliance and Monitoring

You agree to:

Substantiate any claims you make about Appraisal Inbox
Provide evidence of disclosures upon request
Promptly correct any misleading or false statements
Maintain records of promotional activities for at least 2 years
Allow Appraisal Inbox to review and audit your promotional materials

We reserve the right to request changes to any promotional content that does not meet our standards or comply with applicable regulations.

Failure to comply with FTC disclosure requirements may result in immediate termination from the program.

Brand and Trademark Use

Limited License

We grant you a limited, non-exclusive, revocable license to use Appraisal Inbox trademarks and marketing materials solely for promoting Appraisal Inbox under this agreement.

Restrictions

You may not:

Modify our logos or brand assets
Use our trademarks in a way that implies endorsement of your products
Register domain names containing “Appraisal Inbox” or similar variations
Apply for trademarks or trade names that include our brand

All use must follow our brand guidelines (available upon request). We reserve the right to review your use of our trademarks and require corrections within 5 business days of notice.

Confidentiality

You may receive confidential information about Appraisal Inbox, including internal program details, promotional strategies, and customer data. You agree to:

Keep all confidential information private (except standard commission rates which may be public)
Not disclose non-public program terms or strategies
Not share customer information with third parties
Use confidential information only for program participation

Compliance with Laws

You agree to comply with:

Federal Trade Commission (FTC) advertising and disclosure guidelines, including the 2023 Endorsement Guides
CAN-SPAM Act and anti-spam laws
Telephone Consumer Protection Act (TCPA) if using phone/SMS marketing
California Consumer Privacy Act (CCPA) and applicable privacy laws
Our Use Restrictions Policy
All federal, state, and local laws related to marketing and advertising

Data and Privacy

You agree to handle any customer data in accordance with our Privacy Policy and applicable data protection laws.

CCPA Service Provider Requirements

To the extent you receive personal information from us, you are a “service provider” under CCPA and agree to:

Use personal information only to provide affiliate referral services under this agreement
Not sell, rent, release, disclose, or otherwise make available personal information for any commercial purpose
Not retain, use, or disclose personal information outside the direct business relationship
Implement reasonable security safeguards to protect personal information
Notify us within 48 hours of any data breach or unauthorized access
Assist with data subject access, deletion, and opt-out requests
Delete or return all personal information at the end of this agreement (unless retention is required by law)

You will not:

Collect personal information from referred customers beyond what is necessary for promotion
Share or sell customer data to third parties
Use customer data for purposes unrelated to the Affiliate Program

Term and Termination

Term

This agreement begins when you are accepted into the program and continues until terminated by either party.

Termination by You

You may terminate this agreement at any time by providing written notice to support@appraisalinbox.com.

Termination by Us

We may terminate your participation immediately if you:

Violate any terms of this agreement
Engage in fraudulent or illegal activities
Harm the reputation of Appraisal Inbox
Fail to comply with FTC disclosure requirements

We may also terminate the entire Affiliate Program at any time with 30 days notice.

Effect of Termination

Upon termination:

Your affiliate links will be deactivated
You must stop using Appraisal Inbox trademarks
You will receive payment for earned commissions above the minimum threshold
If terminated for cause (fraud, violations, non-compliance), we reserve the right to withhold future recurring commissions
If terminated by you or without cause by us, recurring commissions from existing Qualified Referrals continue to be paid according to the payment terms, provided those customers remain active and in good standing

Modifications to Terms

We may modify this agreement at any time. We will notify you of material changes via email or through the affiliate dashboard at least 30 days before they take effect. Continued participation after changes constitutes acceptance of modified terms.

Modifications will not retroactively reduce commissions already earned, but may adjust future commission rates or terms. The “lifetime” nature of recurring commissions applies as long as: (1) the referred customer remains active and paying, and (2) you remain an affiliate in good standing.

Warranties and Representations

You represent and warrant that:

You have the authority to enter this agreement
You will comply with all applicable laws
Your promotional methods are lawful and ethical
You have all necessary rights to use any content in your promotions
You will not make false claims about Appraisal Inbox

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPRAISAL INBOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR PARTICIPATION IN THE AFFILIATE PROGRAM.

Our total liability to you for any claims arising from this agreement shall not exceed the total commissions paid to you in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Appraisal Inbox from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your violation of this agreement
Your promotional activities
Your violation of any applicable laws
Any false or misleading claims you make about Appraisal Inbox

Dispute Resolution

Any disputes arising under this agreement shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be governed by the laws of the United States and the State of Georgia, without regard to conflict of law principles. Exclusive jurisdiction and venue shall be in the state and federal courts located in Georgia.

General Provisions

Entire Agreement

This agreement constitutes the entire agreement between you and Appraisal Inbox regarding the Affiliate Program.

Assignment

You may not assign this agreement without our written consent. We may assign this agreement at any time.

Severability

If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later.
